Terms of Service

1. Definitions

  • "Platform": the service provided by Cortinovis Brian accessible at TouraCore.
  • "User": anyone accessing or using the Platform.
  • "Tenant": property/business publishing content and receiving bookings.
  • "Guest": user making bookings.

2. Subject

Cortinovis Brian provides a multi-tenant SaaS platform for management of accommodation, restaurants, bike rental, tourist experiences, including payment, booking, channel manager, fiscal compliance (SDI, CIN, tourist tax) features.

3. Registration and account

Registration requires accurate data. The user is responsible for credential security. MFA is recommended for tenant accounts.

4. User obligations

The user undertakes to:

  • Not use the Platform for unlawful purposes.
  • Not upload content violating third-party rights, copyright, privacy, dignity.
  • Not attempt unauthorised access, reverse engineering, mass scraping.
  • Comply with fiscal, tourism, GDPR regulations applicable to their business.

5. Pricing and payments

Service prices are indicated in the subscribed plan. Payments processed via Stripe. Invoices issued electronically via SDI. Non-payment results in suspension within grace period (7 days) and subsequent deactivation.

6. Intellectual property

All IP rights on the Platform belong to Cortinovis Brian. The user retains rights on their own content (photos, texts, logo) granting a non-exclusive licence for service delivery.

7. Liability

Cortinovis Brian provides the service "as is". Not liable for:

  • Content uploaded by tenants.
  • Unavailability due to force majeure, DDOS, third-party infrastructure failures.
  • Indirect losses or loss of profit.

Maximum liability limited to fees paid in the last 12 months.

8. Termination

The user may terminate at any time. Termination does not entail refund of paid fees. Data is retained for 30 days post-termination.

9. Changes to terms

Material changes will be notified 30 days in advance via email. Continued use constitutes acceptance.

10. Governing law and jurisdiction

These terms are governed by Italian law. Exclusive jurisdiction: Via Aldo Moro 12b, 24010 Sedrina (BG), Italia. For consumers the jurisdiction of their domicile applies pursuant to the Italian Consumer Code.
